The Federal Administrative Court (BVerwG) admitted a revision appeal for fundamental legal significance, allowing the proceeding to continue pending a ruling on whether a broadcasting license holder is entitled to utilize the remaining license period following corporate structural changes. The dispute concerns the validity and consequences of altering more than 50% of the ownership and participation shares in a broadcasting company, specifically examining if such changes trigger an obligation to allow the use of the license's remaining term rather than resulting in revocation or non-renewal. The court identified the decisive legal issues as the constitutional principles of proportionality and fundamental rights to freedom of expression (Art. 5 Abs. 1 Satz 2 Alt. 2 GG) and occupational freedom (Art. 12 Abs. 1 GG), which must be balanced against regulatory requirements for changes in provider ownership structures. The decision fixes the court costs and assigns a provisional value to the litigation for the upcoming revision phase.
