Land consolidation: statutory grounds for permitting revision on divergence from case law regarding interim orders
Legislator summary
AI generatedThe Federal Administrative Court (BVerwG) granted the appellant's complaint and permitted a revision appeal, finding that the lower court's decision deviated from established case law regarding the requirements for temporary orders in land consolidation proceedings. The dispute concerned a challenge to a provisional directive issued during a land consolidation process, specifically addressing the legal standards for such interim measures under § 36(1) Sentence 1 of the Federal Land Consolidation Act (FlurbG). By allowing the revision on grounds of legal divergence, the court effectively reversed the lower instance's procedural ruling to ensure consistent application of the doctrine governing provisional administrative orders, while the temporary fee settlement was made pursuant to the Court Costs Act.
