The Federal Administrative Court (BVerwG) granted the plaintiff's complaint, finding that the case presents a question of fundamental importance under § 132 Abs. 2 Satz 1 VwGO, and thus allowed the revision. The dispute concerns the applicability of § 1 Abs. 7 of the Property Regulation Act (VermG) alongside § 1 of the Criminal Rehabilitation Act (StrRehaG) in a context where a DDR criminal verdict had ordered the confiscation of assets. The material facts involve a scenario where the DDR later lifted the confiscation via a clemency decision, but the revocation was not actually executed because the affected individual had previously voluntarily renounced the personal use of the assets after the conviction. The decisive legal issue for the subsequent trial is whether § 1 Abs. 7 VermG remains applicable when a criminal rehabilitation decision under § 1 StrRehaG has already undone the original DDR confiscation order, specifically given the complicating factor of the unexecuted clemency and prior waiver of use.

§ 132 Abs. 2 Satz 1 VwGO; Applicability of § 1 Abs. 7 VermG alongside § 1 StrRehaG where DDR asset confiscation was reversed by clemency but not executed: Die Beschwerde hat Erfolg.
