The Federal Administrative Court (BVerwG) granted leave to appeal, ruling in favor of the plaintiffs' complaint and finding the lower court's judgment insufficient for the final dispute. The case involves a challenge to the validity of an expropriation carried out in Thuringia based on occupation-authority principles, despite a specific prohibition against such measures. The decisive legal issue identified for the upcoming revision is whether the directive issued by the Deutsches Wirtschaftskomitee (DWK) on September 21, 1948, could validly override the explicit expropriation ban established in Number 5 of SMAD Order No. 64, thereby constituting a permissible expropriation under occupation authority as defined in § 1 Abs. 8 Buchst. a of the German Expropriation Act (VermG).
