The Federal Administrative Court granted leave to appeal and admitted the complaint regarding the secondary claim for recognition of eligibility for the higher service career (Laufbahn des höheren Dienstes), establishing that the issue requires further legal clarification, while rejecting the main claim and primary alternative claim for lack of demonstrated grounds for admission, which leaves the lower court's decisions on those specific claims in force. The dispute centered on a public servant's challenge against the responsible authority's refusal to formally recognize his eligibility for the higher service career, despite his successful completion of a specialized professional degree program at a University of Applied Sciences and his subsequent civil service leave to perform duties equivalent to a higher service position as a contract employee. The decisive legal basis concerns the authority's power to deny recognition of higher service career eligibility notwithstanding the successful completion of an accredited degree program and the performance of equivalent duties, with the court determining that the accreditation of the specific study program and the university's internal classification of the degree are not determinative factors for this legal assessment.
