Legislator summary

AI generated

The court considered whether a property owner had been subjected to material expropriation due to unreasonable delays by an appraisal commission. The commission had resumed proceedings nearly three years prior but had taken very few actions and had ceased all activity for over six months. The court found that, despite the complexity of the case, the commission's inaction constituted a violation of the prohibition of undue delay, as no justification was provided. Therefore, the court granted the appeal, acknowledging the delay, but declined to set a specific deadline for the commission's final decision, instead ordering them to expedite the proceedings and conclude the matter promptly with an appealable decision. No party costs were awarded to the appealing municipality.

--- · --- · --- · Geschäftsnummer: · VR.2021.00004 · Entscheidart und -datum: · Endentscheid vom 27.12.2021 · Spruchkörper: · 3. Abteilung/3.
