Legislator summary

AI generated

The administrative court reviewed an appeal concerning compensation for land expropriation, primarily focusing on the compensation amount for an undeveloped building-zoned parcel, while dismissing aspects of the appeal concerning parties not involved in the initial proceeding. The court upheld the lower authority's valuation method, accepting the derived land price of CHF 1,100 per square meter based on comparable sales as falling within the permissible discretionary margin and not violating the law. Furthermore, the court confirmed the cost allocation in the assessment proceedings, finding that because the awarded compensation was close to the opposing party's prior offer, the decision to charge the appellant with one-third of the costs was reasonable under the relevant statute.

--- · --- · --- · Geschäftsnummer: · VR.2013.00005 · Entscheidart und -datum: · Endentscheid vom 16.01.2014 · Spruchkörper: · 3. Abteilung/3.
