Legislator summary

AI generated

Following a prior ruling that partially sent the matter back for re-evaluation, the court addressed a claim for compensation due to planning costs rendered useless by the protective listing of several buildings, which led to the failure of a planned project. The court determined that only 80% of the claimed planning costs, representing self-costs excluding potential profit included in standard fee schedules, were eligible for compensation, and further reduced this amount by 40% due to the claimant's self-responsibility in undertaking project work despite known contractual risks unrelated to the listing. The entitled compensation amount was ordered to bear interest at the relevant bank rate from the time the claim for indemnification was first made.

--- · --- · --- · Geschäftsnummer: · VR.2010.00004 · Entscheidart und -datum: · Endentscheid vom 08.02.2012 · Spruchkörper: · 3. Abteilung/3.
