Legislator summary

AI generated

The case concerned the appeal of a municipality against a decision that excluded owners of properties not directly bordering a newly constructed sidewalk from sidewalk contribution liability under street law. The court affirmed that property owners whose land gains direct, safe access from the street due to sidewalk construction, often to enhance traffic safety, are generally obligated to pay contributions as this constitutes a specific benefit; however, this obligation typically applies only to vertical abutters, and in cases of only lateral abutment, liability is exceptional, such as with large-area developments or parcel reorganization, thus upholding the lower court's determination that properties without direct bordering access were not liable, and rejecting claims based on equity, spatial planning law, or housing promotion law.

--- · --- · --- · Geschäftsnummer: · VR.2009.00005 · Entscheidart und -datum: · Endentscheid vom 03.12.2009 · Spruchkörper: · 3. Abteilung/3.
