Legislator summary

AI generated

A property owner sought reimbursement for infrastructure costs advanced for plots of land, which later became impossible to develop due to zoning changes. The court determined that an agreement between the property owner and the municipality regarding these costs was conditional on the actual development of the land. Since development did not occur, the condition was not met, and the municipality had no obligation to reimburse the costs, nor was there a claim for compensation based on material expropriation. The court also found that the agreement's condition becoming impossible did not trigger liability for damages.

--- · --- · --- · Geschäftsnummer: · VR.2000.00006 · Entscheidart und -datum: · Endentscheid vom 12.04.2001 · Spruchkörper: · 3. Abteilung/3.
