Legislator summary

AI generated

The European Commission of Human Rights declared inadmissible a request concerning the suspension of an occupational change allowance. The applicant argued that this suspension, for a period when she voluntarily ceased working for family reasons, violated her right to found a family under Article 12 of the European Convention on Human Rights. The Commission confirmed its established jurisprudence that Article 12 does not create an obligation for contracting states to financially support a parent who voluntarily stops working for familial reasons, finding the claim incompatible with the Convention's provisions.

Déc. de la Comm. eur. DH du 11 avril 1996, déclarant irrecevable la req. N° 25928/94, Rita Cannatella c / Suisse

Maladie professionnelle.
