Legislator summary

AI generated

This case concerns a complaint that the presumption of innocence was violated due to the use of illegally obtained evidence. The court clarifies that Article 6(2) of the European Convention on Human Rights guarantees the right to be presumed innocent until guilt is legally established. However, the question of whether guilt was legally established through a fair trial falls under Article 6(1), which deals with the right to a fair trial, rather than Article 6(2).

Presumption of Innocence and Fair Trial Rights: Art. 6 § 2 CEDU. Presunzione d’innocenza.

Or, cette référence à l’art. 6 § 1.
