The appellate court addressed the withdrawal of an appeal before the deadline, which rendered the appeal resolved and caused the original judgment to become final retroactively; concurrently, the court determined that the state treasury, rather than the respondent, must bear the costs for the appointed defense in the appeal proceedings, clarifying that the fee amount for the appointed defense counsel in the appellate phase must be decided in a separate resolution according to the fee tariff of the canton where the criminal proceedings took place, with no court fees being levied.

Art. 135 Abs. 2 StPO
The reference to Art. 135 Abs. 2 StPO is necessary as the text mentions it, although the reasoning primarily cites Art. 437 StPO for finality. However, based strictly on the rule, I must check if any part of Art. 135 is explicitly used in the final orders/dispositive. Since the dispositive is missing, I rely on the provided text which seems to be a mix of reasoning and potential dispositive elements. Based on the provided snippet, which only details the reasoning and a cost assignment, and given the exclusion rule focusing strictly on numbered orders, I must be cautious. Let's re-evaluate based on the conclusion structure implied by the text.

Strafprozessordnung. Art. 135 Abs. 1, Art. 135 Abs. 2, Art. 135 Abs. 3 lit. b, Art.

437 StPO.
