Legislator summary

AI generated

The court upheld a conviction based on a witness's testimony regarding an overtaking maneuver, where subsequent investigations substantially corroborated the witness's account of the vehicle involved and the circumstances described. Despite minor inconsistencies in the witness statements, the court reasoned that the totality of the evidence, including a traffic engineering report confirming the theoretical feasibility of the described maneuver at the location, provided a sufficiently coherent and reliable basis for conviction, thus overriding the principle of "in dubio pro reo" concerning minor evidentiary discrepancies.

Nr. 18 Strafprozessordnung. Art. 6 Ziff. 2 EMRK. Art. 29 Abs. 2,

Art. 32 Abs. 1 BV. Art. 249 BStP. Art. 188 Abs. 2, Art. 227

Abs. 1 StPO. Antizipierte Beweiswürdigung. Grundsatz der

freien Beweiswürdigung. Grundsatz «in dubio pro reo».

Indizienbeweis.

gerichtliche verkehrstechnische Gutachten stellte
