An appeal was lodged against the resolution by the State Council approving a spatial planning scheme, but the appellant subsequently communicated the withdrawal of the appeal to the court, rendering the proceedings moot. The court reasoned that because the appeal was withdrawn, the procedure was discontinued, the appeal was struck from the rolls, no court fee was levied, and consequently, the appellant, having effectively lost due to withdrawal, was ordered to pay a fixed sum to the municipality for costs, taking into account that the challenge was ostensibly brought in the public interest.
