An appeal was filed against a state council resolution that approved a zoning plan classifying a specific plot of land as agricultural, despite the appellant seeking industrial zoning for that parcel, but the appellant subsequently notified the court of their decision to withdraw the appeal, rendering the proceeding moot. The court reasoned that because the appellant withdrew the appeal, the procedure must be stricken from the record, no court fee would be charged, and the appellant, deemed the losing party upon withdrawal, was ordered to pay procedural costs to the opposing municipality, rejecting the appellant's claim that the presiding judge had assured them they would be exempt from this cost.

statuendo sul ricorso 28 maggio 2002 di

__________ __________, __________ __________ __________, contro

la risoluzione 7 maggio 2002 (n. __________) con cui il Consiglio di Stato ha approvato il piano regolatore di __________;

viste le risposte:

- 16 agosto 2002 del Comune di __________;

- 27 settembre 2002 del Dipartimento del territorio Divisione pianificazione territoriale;

letti ed esaminati gli atti;

ritenuto e considerato, in fatto ed in diritto

che il piano regolatore di __________, approvato dal Consiglio di Stato con risoluzione

7 maggio 2002, assegna il mapp. __________ alla zona agricola;

che il ricorrente ha chiesto l’inserimento nella zona industriale del mapp. __________;

che, all’udienza del 24 settembre 2003, l'insorgente, si è riservato un termine di

15 giorni per comunicare al Tribunale il ritiro del ricorso;

che con scritto 25 settembre 2003 il ricorrente ha comunicato di ritirare il ricorso;

che, il municipio, d’accordo con lo stralcio del gravame, ha protestato le ripetibili;

che il procedimento di cui trattasi è pertanto divenuto privo di oggetto;

che il gravame, ritirato, va dunque stralciato dai ruoli;

che di conseguenza il Comune di __________, assistito da un patrocinatore, ha diritto al versamento di ripetibili da parte del ricorrente il quale, a seguito del ritiro dell'impugnativa, dev'essere considerato soccombente giusta l’art. 31 PAmm (cfr. Borghi/Corti, Compendio di procedura amministrativa ticinese, ad art. 31 n. 2; inoltre Merkli/Aeschlimann/Herzog, Kommentar zum bernischen VRPG, Berna 1997, ad art. 110 cpv. 1 n. 3 e seg.);

che, invano, l'insorgente spera di poter spuntare l'esenzione da tale obbligo, asserendo che il Presidente del Tribunale gli avrebbe dato assicurazioni di merito all'udienza;

che, in effetti, i Tribunali possono solo disporre circa il pagamento o meno della tassa di giustizia giusta l'art. 28 PAmm: le ripetibili devono invece sempre essere attribuite alla parte vittoriosa, giusta l'art. 31 PAmm, salvo rinuncia da parte della stessa;

che il Tribunale non preleva tasse di giustizia (art. 28 PAmm);

decreta:

1. Il ricorso è stralciato dai ruoli.

2. Non si preleva una tassa di giustizia. Il ricorrente è condannato a versare al Comune di __________ fr. 500.- (cinquecento) per ripetibili.
