Legislator summary

AI generated

The administrative court ruled that awarding a contract requires formal notification of the contract award decision via a contestable official decree issued by the responsible awarding authority, as mandated by relevant public procurement law sections, which must include the price of the successful bid and justification for it being the most economically advantageous, allowing for proper appeal; failure to issue this required formal ruling, instead notifying an unsuccessful bidder only through a letter from the planning engineer, constitutes a serious formal error and means a legally compliant award did not occur, necessitating the matter be returned to the authority to rectify the deficiency.

Rechtsprechung Luzern

Instanz: · Verwaltungsgericht

Abteilung: · Verwaltungsrechtliche Abteilung

Rechtsgebiet: · Öffentliches Beschaffungswesen

Entscheiddatum: · 28.07.1999

Fallnummer: · V 99 159

LGVE: · 1999 II Nr. 16
