## Provisions

### Art. 1 Intercantonal Agreement on the Schurtanne-Chräloch-Töbeli Agricultural Corporation - Purpose and Legal Nature

1. The Schurtanne-Chräloch-Töbeli Land Cooperative aims to maintain and expand the access road Schurtanne-Chräloch-Töbeli within the areas of the municipalities of Urnäsch and Hemberg.

2. It is a land improvement company according to Article 703 of the Swiss Civil Code of December 10, 1907, and Article 167 et seq. of the Appenzell Outer Rhodes Law on the Introduction of the Swiss Civil Code of April 27, 1969, with its headquarters in Urnäsch (hereinafter referred to as the Company).

### Art. 2 Intercantonal Agreement on the Schurtanne-Chräloch-Töbeli Agricultural Corporation - Applicable Law

1. The company is subject to the law of the Canton of Appenzell A. Rh.

### Art. 3 Intercantonal Agreement on the Schurtanne-Chräloch-Töbeli Agricultural Corporation - Statutes

1. The Articles of Association of the Company regulate

a) Membership;

b) Cost allocation;

c) Organization;

d) Rights and obligations of the members.

### Art. 4 Intercantonal Agreement on the Schurtanne-Chräloch-Töbeli Agricultural Corporation - Legal Personality

1. The company acquires legal personality upon the approval of its statutes by the competent authority of the Canton of Appenzell A. Rh.

### Art. 5 Intercantonal Agreement on the Schurtanne-Chräloch-Töbeli Agricultural Corporation - Supervision

1. The competent authority of the canton of Appenzell A. Rh. exercises supervision over the enterprise in agreement with the competent authority of the canton of St. Gallen.

### Art. 6 Intercantonal Agreement on the Schurtanne-Chräloch-Töbeli Agricultural Corporation - Disputes

1. The competent authority of the Canton of Appenzell A. Rh. adjudicates public law disputes between companies and members.

2. Disputes between the contracting cantons are submitted to the Federal Supreme Court pursuant to Art. 189 para. 1 lit. d of the Federal Constitution.

### Art. 7 Intercantonal Agreement on the Schurtanne-Chräloch-Töbeli Agricultural Corporation - Execution

1. This agreement shall be applied by the contracting cantons from the date of signing.
