Legislator summary

The court addressed whether a party that had filed a declaration waiving any appeal regarding a lower court decision could still file a cross-appeal to the higher court. The court reasoned that since a declaration of waiver under the relevant statute does not prevent a party from filing a main appeal, it likewise cannot bar the filing of a cross-appeal, as the cross-appeal is generally treated like a normal appeal while the main appeal is pending, and the relevant procedural law provides no basis for a different treatment of the cross-appeal in this context.

98/99 4 Zivilprozessordnung. Art. 101 Abs. 1, Art. 245 Abs. 2 ZPO.
