The court reviewed an appeal where the lower court supplemented its reasoning in its response, detailing statistical land sales, which allowed the opposing party to raise new factual arguments related to that supplement during the instruction hearing without violating the principle of *eventualmaxime* because these arguments were reactive to the lower court's new submission. However, the appellant's challenge to the apportionment of land area between touristic and residential zones, which was evident from the original decision's reasoning and not the lower court's supplement, was deemed inadmissible as untimely because it should have been raised in the initial appeal brief; furthermore, this challenge was unfounded as the relevant commission relied on the current zoning plan.

96/97 27 Kantonales Verfahrensrecht. Art. 58 VRPV.
