Legislator summary

AI generated

In the cantonal administrative appeal procedure, where professional representation is reserved for admitted lawyers to ensure an orderly process, a stricter standard should be applied to the justification of the appeal and the formulation of the grounds for complaint compared to proceedings before the Federal Court. Despite the court's duty to apply the law ex officio, it is generally not expected to search for all possible grounds of complaint in a submission filed by counsel; instead, it should usually be assumed that the representative has clearly indicated the intended grounds of appeal.

96/97 22 Kantonales Verfahrensrecht. Art. 64 i.V.m. Art. 49 Abs. 1 VRPV.
