§ 105 Constitution of the Canton of Basel-Stadt, (2005) The Council of State participates in the preparation of legislative projects as well as in the decision-making by the Grand Council. The Council of State issues normative provisions in the form of ordinances insofar as the Constitution or the law authorizes it to do so. The law may provide that the Council of State issues other provisions if the legislative procedure is not suitable. This delegation is restricted to a specific area and defines the limits. In cases of urgency, it may issue the necessary provisions by way of ordinance to adopt higher law, provided that the Grand Council is unable to do so itself within the framework of the ordinary or urgent legislative procedure. These provisions are to be replaced without delay according to the ordinary procedure.

Der Regierungsrat wirkt bei der Vorbereitung der Gesetzgebung und Beschlussfassung des Grossen Rates mit.
Der Regierungsrat erlässt rechtsetzende Bestimmungen in der Form der Verordnung, soweit er durch Verfassung oder Gesetz dazu ermächtigt ist.
Das Gesetz kann vorsehen, dass der Regierungsrat weitere Bestimmungen erlässt, soweit sich das Gesetzgebungsverfahren dafür nicht eignet. Das Gesetz hat die Delegation auf einen bestimmten Bereich zu beschränken und ihren Rahmen festzulegen.
Zur Einführung übergeordneten Rechts kann der Regierungsrat in Fällen zeitlicher Dringlichkeit und sofern der Grosse Rat nicht selbst im ordentlichen oder dringlichen Gesetzgebungsverfahren beschliessen kann, Bestimmungen als Verordnung erlassen. Diese sind ohne Verzug durch ordentliches Recht abzulösen.
