Art. 10 : Verwaltungsrechtspflegegesetz (VRG)

Art. 10

50 1 Schriftliche Anordnungen sind zu begründen und mit

einer Rechtsmittelbelehrung zu versehen, die das zulässige ordentliche

Rechtsmittel, die Rechtsmittelinstanz und die Rechtsmittelfrist bezeich-

net.

2 Erlasse, ausgenommen die Kantonsverfassung³ und kantonale

Gesetze, werden mit einer Rechtsmittelbelehrung veröffentlicht.

3 Schriftliche Anordnungen werden mitgeteilt

den Verfahrensbeteiligten,

b. auf ihr Gesuch hin anderen Personen, wenn sie durch die Anord-

nung berührt sind und ein schutzwürdiges Interesse an deren Auf-

hebung oder Änderung haben,

c. der Schlichtungsstelle im Sinne des Gleichstellungsgesetzes vom

24. März 199525, wenn eine Schlichtungsverhandlung durchgeführt

wurde.

4 Eine Anordnung kann amtlich veröffentlicht werden, wenn sie

a. nicht zugestellt werden kann,

b. zahlreichen Personen mitgeteilt werden müsste,

c. Personen unbekannten Aufenthalts mitgeteilt werden müsste,

d. Personen mitgeteilt werden müsste, die sich nur mit unverhältnis-

mässigem Aufwand vollzählig bestimmen lassen.

5 Anstelle der vollständigen amtlichen Veröffentlichung der Anord-

nung kann auch bekannt gemacht werden, bei welcher Amtsstelle die

Anordnung innert welcher Frist bezogen werden kann.
