Art. 27 GTar · Bestimmungskriterien

1. Das Honorar hält sich zwischen einem in diesem Kapitel vorgesehenen Minimum und Maximum; berücksichtigt wird die Natur und Bedeutung des Falls, die Schwierigkeit, der Umfang, die vom Rechtsbeistand nützlich aufgewandte Zeit und die finanzielle Situation der Partei.

2. Das Honorar richtet sich in der Regel nach dem Streitwert.

3. Lässt sich der Streitwert nicht beziffern, so wird das Honorar nach den in Absatz 1 genannten Bemessungselementen bestimmt.

4. Die Behörde setzt das Honorar in runden Zahlen fest, indem sie zudem den Sonderbestimmungen in den verschiedenen Prozessordnungen nachkommt.

5. Die Entschädigungen verstehen sich inklusive Mehrwertsteuer. Wenn der Mehrwertsteuersatz im Zeitpunkt des Inkrafttretens des vorliegenden Gesetzes geändert wurde, passt der Staatsrat auf dem reglementarischen Weg die im vorliegenden Gesetz vorgesehenen Honorare an.
