Zusammenfassung (Sachverhalt & Erwägungen)

KI-strukturiert

The High Court of Cassation and Justice admitted the request filed by the plaintiff, a scientific agricultural academy, to transfer (strămutare) the trial from the Botoșani Court to the Bistrița-Năsăud Court, an order that is final and without appeal, effectively displacing the lower court's jurisdiction. The dispute concerned a procedural motion to relocate a civil case pending at the Botoșani Court, despite the Public Prosecutor's recommendation for dismissal on the grounds that the transfer was unfounded and that a hearing date was already scheduled for October 10, 2013. The decisive legal basis for the court's ruling was the doctrine of *strămutare*, a specific jurisdictional transfer mechanism under Romanian civil procedure law that allows a case to be moved to a different court due to local influences or specific circumstances that prejudice impartiality, thereby overriding the standard territorial jurisdiction rules.
