Încheierea nr. 4048/2013 — Dismissal of case transfer request as moot due to prior final resolution of the underlying dispute

The High Court of Cassation and Justice dismissed the petition for the transfer of the case, ruling that the application had become moot and leaving the original jurisdiction in force. The dispute involved a request to transfer Case No. 31531/299/2011 from the Bucharest Court of Appeal to another court; however, the respondent and the Public Ministry argued for dismissal because the electronic court registry indicated the underlying case had already been resolved on July 1, 2013. The court relied on the procedural doctrine that a motion for transfer (strămutare) is without object if the underlying proceedings have been finally decided, thereby rendering the request for reassignment unnecessary.
