Zusammenfassung (Sachverhalt & Erwägungen)

KI-strukturiert

The cantonal executive body ruled that the obligation to construct civil protection shelters under the relevant federal law applies when a building is erected on the site of a demolished structure, qualifying the new construction as a "new building" regardless of whether the initial demolition was voluntary or involuntary. However, if a building is only partially destroyed and its foundation or other parts are reused, the reconstruction does not constitute a new building unless the rebuilding amounts to a significant alteration and the structure includes subterranean cellar spaces, in which case the obligation may arise.

Instanz: · Regierungsrat Abteilung: · - Rechtsgebiet: · Zivilschutz Entscheiddatum: · 14.12.1993 Fallnummer: · RRE Nr. 3470 LGVE: · 1993 III Nr. 17 Leitsatz: · Pflicht zum Bau von Schutzräumen. Art. 2 Abs. 1 BMG.
