S-a luat în examinare cererea formulată de petenta U.K.S.P. (SC C.A.P.S. SRL), prin care solicită strămutarea judecăți procesului civil ce formează obiectul Dosarului nr. 4765/1285/2011 al Tribunalului Comercial Cluj.

La apelul nominal a răspuns petenta U.K.S.P. (SC C.A.P.S. SRL), prin avocat M.S.O., cu împuternicire avocațială la dosar la fila 10, lipsă fiind intimata SC S.F.C.C.F.R. Cluj SA.

Ministerul Public este reprezentat de procuror L.D. din cadrul Parchetului de pe lângă Înalta Curte de Casație și Justiție.

Procedura legal îndeplinită.

Se referă de magistratul asistent asupra faptului că, potrivit programului de evidență informatizată a instanțelor, dosarul a cărui strămutare se solicită are termenul fixat la data de 14 octombrie 2013.

Se mai referă de către magistratul asistent că intimata a depus la dosar întâmpinare.

Strămută judecata cauzei de la Tribunalul Comercial Cluj la Tribunalul Brașov.
