Legislator-Zusammenfassung

KI-generiert

The Court of Cassation declared the appeal inadmissible because the sole ground of appeal concerned the sentencing discretion exercised by the trial court. The appellant argued for a violation of law regarding the punitive treatment, but the court noted that determining the penalty, including aggravating and mitigating circumstances, falls within the exclusive discretion of the judge of first instance under Articles 132 and 133 of the Criminal Code. Consequently, the appeal was rejected as manifestly unfounded, and the appellant was ordered to pay the costs and a fine.

Legislator-Regeste

Art. 132, 133 cod. pen.; The determination of the penalty, including adjustments for aggravating and mitigating circumstances, constitutes the discretionary power of the judge of first instance and is not subject to review on the merits by the Court of Cassation.

to a SONDRIO il 12/07/1993 avverso la sentenza del 02/12/2025 della CORTE APPELLO di MILANO dato avviso alle parti; udita la relazione svolta dal Consigliere GIUSEPPE NICASTRO;RITENUTO IN FATTO E IN DIRITTO Letto il ricorso proposto nell'interesse di Slim Ouerghi; rilevato che l'unico motivo di ricorso, con il quale si deduce la violazione di legge ed il vizio della motivazione in relazione al trattamento sanzionatorio, non è consentito in sede di legittimità ed è manifestamente infondato, atteso che, secondo il consolidato orientamento della giurisprudenza, la determinazione della pena — anche con riferimento agli aumenti ed alle diminuzioni previsti per le circostanze aggravanti ed attenuanti, nonché alla fissazione della pena base — rientra nella discrezionalità del giudice di merito, che deve esercitarla nel rispetto dei criteri di cui agli artt. 132 e 133 cod. pen.; che, nella specie, tale onere motivazionale risulta adeguatamente assolto mediante un congruo riferimento agli elementi ritenuti decisivi o rilevanti (si veda, in particolare, la pagina 4 della sentenza impugnata); ritenuto che, per tali motivi, il ricorso debba essere dichiarato inammissibile, con conseguente condanna del ricorrente al pagamento delle spese processuali e della somma di euro tremila in favore della Cassa delle ammende;
