The Court of Cassation declared the appeal by Rachele Gloria inadmissible and ordered her to pay procedural costs. The appellant argued that the lower court erred in finding no criminal attempt and misidentified the subjective element of the crime. The court rejected these claims because the appeal grounds were not formulated in legally permissible terms for a review on points of law.

Italian Supreme Court dismisses appeal as evidence evaluation is not a separate legal issue from fact-finding.
Ordinanza — n. 20805/2026 — snpen
Cassation court dismisses appeal claiming lack of witness cross-examination and illogical evidence as inadmissible. The appeal is rejected because the arguments merely repeat those from the appellate court and lack specific factual grounding. The lower court's reasoning was deemed sufficient and logically sound regarding the criminal liability. The appeal is declared inadmissible due to generic formulation and failure to address the specific evidence. The court upholds the first-instance judgment on criminal responsibility. The decision confirms the validity of the evidence-based reasoning used by the territorial court. The appeal fails to meet the threshold for admissibility under Italian procedural law. The court rejects the claim that the witness testimony was decisive for the outcome. The ruling emphasizes the need for precise arguments rather than generic complaints. The decision affirms the finality of the first-instance judgment on the criminal charges.
