Legislator-Zusammenfassung

KI-generiert

The Court of Cassation declared the appeal by Marianna Ornella Cardinale inadmissible and ordered her to pay costs. The appellant argued for territorial incompetence and challenged the lower court's fact-finding, but the court found these arguments merely repetitive or improperly formulated for a legitimacy review. Consequently, the court rejected the request to reconstruct facts using different evaluation criteria, upholding the territorial court's reasoning on liability and the crime's existence.

Art. 360 c.p.p.; Art. 361 c.p.p.: Appeals in the interest of law are inadmissible if they merely repeat arguments already examined or attempt to reconstruct facts using criteria different from those adopted by the territorial court, which has already provided a reasoned decision free of the alleged defects.
