Cassation court dismisses appeal claiming heavier charge misclassification under Art. 448 CPP despite lighter sentence.
Legislator-Zusammenfassung
KI-generiertThe Court of Cassation declared the appeal inadmissible de plano, ordering the appellant to pay court costs and a fine. The appellant argued that a heavier charge was incorrectly applied under Article 448, paragraph 2-bis of the Code of Criminal Procedure, even though the imposed sentence was not illegal. The court rejected this claim, ruling that the procedural defect did not justify overturning the lower court's decision on the merits.
