Legislator-Zusammenfassung

KI-generiert

The Court of Cassation declared the appeal inadmissible, rejecting the claim that the lower court exceeded statutory sentencing limits. The appellant argued the penalty for the crime in question was higher than the minimum allowed, while the court maintained that sentencing gradations fall within the trial judge's discretionary power. Consequently, the appeal was dismissed, and the appellant was ordered to pay court costs and a fine.

Art. 56, 628 cod. pen.; Art. 132, 133 cod. pen.: The Court of Cassation holds that the gradation of the penalty, including adjustments for aggravating and mitigating circumstances, constitutes the discretionary power of the judge of the merits and is not subject to review on the ground of exceeding statutory minimums.

CONSIDERATO IN DIRITTO
