Legislator-Zusammenfassung

KI-generiert

The Court of Cassation declared the appeal by Virginia Avola inadmissible due to the generic nature of her arguments and a total lack of specific motivation. The appellant claimed non-recognition of generic mitigating circumstances, but the court found her sole argument consisted merely of listing jurisprudential maxims without concrete application. Consequently, the lower court's conviction under Articles 337 and 349 of the Penal Code was upheld, and the appellant was ordered to pay procedural costs and a fine.

Legislator-Regeste

Art. 367 c.p.p.; Art. 368 c.p.p.: An appeal is inadmissible if the grounds are merely generic listings of legal maxims lacking specific factual application or if the decision suffers from a total absence of motivation on the contested points.

CONSIDERATO IN DIRITTO
