Legislator-Zusammenfassung

KI-generiert

The Court of Cassation declared the appeal inadmissible because the sole ground of appeal was improperly formulated and repetitive of arguments already rejected at the appellate level. The appellant argued against the conviction for online fraud, claiming the lower court erred in attributing responsibility for the victim's funds credited to his Postepay account. The court rejected this, noting the appellant's participation in the crime and the clear evidence of unjust enrichment flowing to his account, while dismissing the cited precedent as applicable to a different type of fraud.

Art. 362, comma 1, lett. a) c.p.p.; Art. 363, comma 1, lett. a) c.p.p.: An appeal is inadmissible if the grounds are not formulated in terms permitted by law or if they are merely a repetition of arguments already examined and rejected in the judgment under appeal.

CONSIDERATO IN DIRITTO

Letto il ricorso proposto nell'interesse di Shon Truzzi; ritenuto che l'unico motivo di ricorso, con cui si deduce vizio della motivazione posta a base del giudizio di responsabilità, oltre che manifestamente infondato, non è formulato in termini consentiti dalla legge in questa sede, essendo riproduttivo di profili di censura già dedotti in appello e già esaminati e disattesi dalla Corte territoriale, la quale, facendo corretta applicazione dei principi di diritto consolidati nella giurisprudenza di legittimità (cfr. Sez. 7, ord. n. 24562 del 18/4/2023, Montebello, non massimata), ha correttamente affermato la partecipazione dell'odierno ricorrente alla realizzazione del reato di truffa on -line ascrittogli, sussistendo una chiara ed evidente ipotesi di concorso in detto reato nella condotta di chi si sia impossessato dell'ingiusto profitto confluito sulla sua carta Postepay (si veda pag. 4 della impugnata sentenza, ove si è sottolineato come la somma pagata dalla persona offesa per il bene mai consegnatole sia stato accreditato sul conto della Postepay intestata al ricorrente, la quale, in assenza di denunce di smarrimento della stessa, deve ritenersi che fosse nella sua piena disponibilità); che la giurisprudenza indicata in ricorso si riferisce alla diversa fattispecie di frode informatica; rilevato, pertanto, che il ricorso deve essere dichiarato inammissibile, con la condanna del ricorrente al pagamento delle spese processuali e della somma di euro tremila in favore della Cassa delle ammende;
