Legislator-Zusammenfassung

KI-generiert

The Court of Cassation declared the appeal inadmissible because the appellant, Giuseppe Bevilacqua, formally withdrew his request on January 16, 2026. Although the lower court had partially mitigated his sentence for illegal cocaine distribution, the appellant's voluntary renunciation of the remedy rendered the cassation proceeding unnecessary. Consequently, the court ordered the dismissal of the appeal and condemned the appellant to pay the associated procedural costs.

Legislator-Regeste

Art. 366 c.p.p.; Art. 370 c.p.p.: A cassation appeal is inadmissible if the appellant expressly renounces the remedy before the Court, thereby terminating the litigation and subjecting the appellant to the payment of costs.
