Legislator-Zusammenfassung

KI-generiert

The Court of Cassation dismissed the appeal against the Second Instance Court of Reggio Calabria for absolute generality of censure. The appellant argued against the conviction under Article 335 of the Penal Code, but the court found the objections lacked specific reference to the appellate judgment's reasoning. Consequently, the court ruled that factual evaluations and evidence assessment remain within the exclusive domain of the trial judges.

Art. 616 c.p.p.; Art. 335 c.p.: An appeal is inadmissible if the censure is absolutely generic and fails to address the specific reasoning of the lower court regarding the existence of criminal elements or the evaluation of evidence.
