Legislator-Zusammenfassung

KI-generiert

The Cassation Court declared the appeal inadmissible because the contested grounds for non-prosecution were already thoroughly examined and rejected by the trial court. The appellant argued that the lower court failed to consider the objective disvalue of the evasion conduct and the intensity of the intent, but the court found these arguments legally sound and free of logical inconsistencies. Consequently, the court ruled that the lower court's judgment on these merits was not subject to review at this stage.

Legislator-Regeste

KI-generiert

Art. 131 bis c.p.; Art. 616 c.p.p.: When lower courts have already adequately examined and rejected specific grounds for non-prosecution based on the objective disvalue of conduct and the intensity of intent, a cassation appeal challenging those specific points is inadmissible as it lacks procedural standing.
