Federal Insurance Court Ruling on Dynamic Recalculation of Occupational Benefit Invalidity Pension Under Overcompensation Rules The case concerns the calculation and adjustment of an occupational benefit invalidity pension ($\mathrm{BVG}$) in the context of overcompensation rules ($\mathrm{OPP} 2$ Arts. 24, 25), specifically when combined with benefits from accident or military insurance. The claimant sought an increase in her pension, arguing that the overcompensation limit—defined as 90% of the hypothetical annual earnings lost due to invalidity—should be dynamically adjusted over time to reflect the salary she would have otherwise earned. The lower court denied this, holding that adjusting the benefit was at the discretion of the pension institution under $\mathrm{OPP} 2$ Art. 24 al. 5. The Federal Insurance Court overturned this, ruling that if the underlying calculation basis for overcompensation, including the hypothetical income achievable without invalidity, changes significantly after the initial pension fixation (meaning a change of at least 10%), the pension institution is legally obligated to recalculate the benefit. The court found that this obligation stems from the general principles of overcompensation and coordination rules ($\mathrm{OPP} 2$ Art. 24 al. 1), not merely from the discretionary provision, thereby compelling the institution to re-evaluate the benefit based on the current estimated lost earnings.

Regeste

ATF 123 V 209

consid. 5b;

ATF 122 V 154

consid. 3c).

BGE 123 V 88

ff., in: RSAS 1998 p. 161 sv.; ISABELLE VETTER-SCHREIBER, Klärung des Begriffs des "mutmasslich entgangenen Verdienstes", in: Personal Vorsorge 1997, p. 631).

consid. 3c; cf. aussi PETER, Die Koordination von Invalidenrenten, thèse Fribourg 1997, p. 339 ss).
