Simple Bodily Harm with Dangerous Instrument (Ice Skates)
Legislator-Zusammenfassung
KI-generiertSimple Bodily Harm with Dangerous Instrument (Ice Skates) The case concerns whether a simple bodily harm (Art. 123 No. 1 para. 2 Swiss Penal Code) was committed using a dangerous tool, specifically ice skates, following a forceful kick to a person's leg. The court reasoned that the dangerous nature of an instrument is determined by its manner of use, citing precedents where ordinary objects like a beer mug, when thrown, were deemed dangerous. The canton authority classified the ice skate—composed of a tapered, somewhat sharp steel blade and a serrated front part—as a dangerous instrument because its forceful use against a person's leg could cause serious cuts and potentially severe hemorrhaging. The Federal Supreme Court confirmed that these considerations did not violate federal law, affirming that the accused, by delivering a kick while wearing such skates, intentionally used a dangerous instrument under the scope of the law.

Extrait des considérants:
