## Zusammenfassung (Sachverhalt & Erwägungen)

The High Court of Cassation and Justice dismissed the applicant’s request to transfer Case No. 26543/215/2011 from the Craiova District Court to another equal court on grounds of legitimate suspicion, and rejected the respondent’s exception of material incompetence, leaving the case with the Craiova District Court; the decision is final and without appeal. The dispute arose in a civil case where the applicant sought case transfer under procedural rules, and the respondent argued the High Court lacked material competence under Article 142 of the new Civil Procedure Code. The Court held that, under Article 24 of the new Civil Procedure Code, procedural law applies only to proceedings commenced after its entry into force, and since the main case was filed on 26 September 2011, before the new code took effect, the transfer request—being a procedural incident—is governed by the old procedural rules, making the High Court competent; on the merits, the request was denied.

Or, potrivit art.
