## Zusammenfassung (Sachverhalt & Erwägungen)

A claimant sought an enforcement action compelling a defendant to complete road surfacing under a public-law development agreement concluded implicitly in 1986, and to transfer the relevant road section to the municipality, given that previous court rulings confirmed the agreement's validity and non-prescription. The court reasoned that while a public-law agreement involving property transfer generally requires a public deed under the Civil Code, invoking this formal defect to refuse performance after substantially fulfilling the agreement constitutes an abuse of right contrary to good faith. Therefore, despite the formal defect, the claimant had an enforceable claim for the outstanding obligation, although the transfer of property ownership must follow the process outlined in the original proposal, requiring the defendant to gratuitously cede the affected land to the claimant upon completion of the works.

Art. 54 OG: Cited in the list of legal norms, likely related to procedural aspects of the initial appeal structure, although the dispositive itself concerns specific obligations. Art. 127 OR: Cited in the list of legal norms, likely relating to the prescription of claims, which was discussed and dismissed in the reasoning.

| | | | | | | --- | --- | --- | | **Geschäftsnummer:** | **VK.2004.00002** | | | Entscheidart und -datum: | Endentscheid vom 03.03.2005 | | | | | Spruchkörper: | 3. Abteilung/3. In seinem Urteil vom 20.
