Cassation appeal dismissed for manifest unfoundedness; prescription term calculated from judgment reading date, not deposit.
Legislator-Zusammenfassung
KI-generiertThe Court of Cassation dismissed the appeal filed by Immacolata Maria Porricelli regarding the prescription of a crime. The appellant argued that prescription had matured between the deposit of the judgment and the notification of the default extract, but the court held that the maximum prescription term must be calculated from the date of the judgment's pronouncement, specifically the reading of the operative part. Consequently, the court ruled that the appeal was manifestly unfounded, establishing no valid litigation relationship and ordering the appellant to pay the procedural costs and a fine.
Legislator-Regeste
KI-generiertArt. 157 cod. proc. pen.; Art. 616 cod. proc. pen.: The term for the maximum prescription of a crime is calculated from the date of the judgment's pronouncement (reading of the operative part), not from the deposit of the judgment; an appeal declared manifestly unfounded does not create a valid litigation relationship allowing the court to examine prescription facts occurring after the judgment.
